IF YOU SUBSCRIBE TO MEMBER SERVICES, YOU REPRESENT AND GUARANTEE THAT YOU ARE NOT IN THESE COUNTRIES.

THESE TERMS OF USE HAVE A MANDATORY ARBITRATION PROVISION THAT, AS DETAILED BELOW IN SECTION 17, REQUIRES THAT DISPUTES BE SETTLED THROUGH ARBITRATION, NOT JURY TRIALS OR ANY OTHER KIND OF COURT PROCEEDINGS.

You agree that these Terms of Use are backed by fair and valuable consideration, which you have received and which is acknowledged here. These Terms of Use may be changed, expanded, or updated from time to time, and new rules may be added for certain Site features. Any changes to these Terms of Use can be made at any time and will take effect as soon as they are posted on the Site, so be sure to check them often. The date at the top of this page that says “effective” shows when these Terms of Use were last changed.

If you sign up for Member Services, GWF will also send an e-mail to the last address you gave when you set up your account when the Terms of Use are changed in a significant way. If you don’t agree to the new Terms of Use, GWF has the right to stop you from using the Member Services.

At the end of most sections of these Terms of Use, there is a short, high-level summary to help you understand what that section is about. These summaries are only there for reference. The Site is owned and run by GWF and others under contracts, and the Materials (including any intellectual property and other rights related to them) belong to and will always belong to GWF, its licensors, and suppliers. Copyright, trademark, and other U.S. and international laws protect the Materials and how they were chosen, put together, arranged, and put together, and you agree that these rights are valid and can be enforced. The Materials may only be used to the extent necessary for your authorized use of the Site, as described in these Terms of Use or as expressly authorized in writing by GWF or if so indicated in writing by GWF, its licensors, or suppliers. If you change the Materials or use them for something other than what they were made for, you are breaking our copyright and other property rights. We can make changes to the Site or take away materials or features at any time, for any reason or no reason at all. You agree that using the Site or the Materials doesn’t give you any rights to them.
At the moment, GWF lets you read free reviews on the Site (“Reviews”) of a limited number of different types of content, such as movies, books, apps, TV shows, video games, websites, music, etc., that were chosen by GWF. From time to time, GWF may, at its sole option and discretion, increase or decrease the number of Reviews that can be viewed for free on the Site, or it may shorten or lengthen the amount of time that this limit is in effect. If you want to see more Reviews than the limit at the time, you will need to buy a subscription to Member Services. You agree that you won’t try to get around any restrictions on how many Reviews you can read for free on the Site in a certain amount of time and that you won’t try to do so either.
Even though GWF tries to make sure its materials are useful and correct, laws, regulations, data, and other types of information change often and can be interpreted in different ways. Also, each situation has its facts and circumstances. So, even though GWF tries to put together the Materials with reasonable care, they may not be up-to-date, accurate, or complete. Also, the Materials should not be taken as professional advice on any subject, and making the Materials available or using them is not meant to create a professional services relationship and does not do so. In some cases, we may have to remove content from a Member Service because of rules from our licensors or other legal or policy reasons. GWF won’t be responsible if you can’t use the site for any reason.
The trademarks, logos, and service marks on the Site (collectively called “Trademarks”) belong to GWF, GWF’s licensors and suppliers, and other companies. Common Sense, Common Sense Media, Common Sense Education, Common Sense Kids Action, and any logos that go with them are our Trademarks. The Trademarks owned by GWF, whether they are registered or not, may not be used with any product or service that does not belong to GWF, in a way that is likely to confuse with GWF, or in a way that is bad for GWF. Nothing on the Site should be taken as a license or right to use any Trademark, whether by implication, estoppel, or otherwise, without the express written permission of GWF, GWF’s licensors or suppliers, or the third party owner of any such Trademark. Any use of the Trademarks and any goodwill that comes with them will only help GWF, its suppliers or licensors, or the third party who owns the Trademarks. Any wrong use of Trademarks is against the law, and GWF will fight hard to protect its intellectual property rights in these Trademarks, including through civil and criminal proceedings.
As far as you and I are concerned, we own all the images and other content on the Site. You can use these images and other materials as long as you follow these rules. You can’t change them, though. We try to keep the Site up-to-date, but it’s possible that the Site may not be accurate or complete, or that content in a Member Service may not always be available.
There is a limit to how many Reviews you can read for free on the Site in a certain amount of time. GWF may change that limit and/or that period from time to time, if and when it wants to. If you want to read more Reviews than the relevant limit during the relevant period, you will have to buy a subscription to the Member Services. You agree that you won’t try to get around any limits on how many Reviews you can read for free on the Site, and you won’t try to do so either.
All of the trademarks and logos on the Site either belong to us or to the people who own them. You can’t use these trademarks and logos unless the owners of those trademarks and logos permit you to do so.

3. SUBMISSION OF MATERIALS

GWF wants and appreciates your contributions to the Site in the places where you can do so. In these areas, users can post reviews, comments, and other content, as long as they follow GWF’s Code of Conduct, our Community Guidelines, these Terms of Use, and our Privacy Policy.
Please keep in mind that because we and our agents let users post reviews and other information on the Site and may in the future host other types of forums on the Site (collectively, the “Forums”) and, therefore, redistribute materials you give us, we need certain rights to those materials. So, if you send or send us reviews, comments, creative suggestions, ideas, notes, concepts, information, or other materials (collectively, “Submissions”), or if you post such Submissions on any part of the Site, you give us and our designees a worldwide, non-exclusive, assignable, sublicensable (through multiple tiers), royalty-free, perpetual, irrevocable right and license to reproduce, distribute (through multiple tiers), adapt, modify, edit We won’t have to keep any of the Submissions secrets, give credit, or do anything else with them, and we won’t be responsible for how any Submissions are used or shared. GWF is not responsible for anything you or anyone else posts on the Site. This includes if you make any of your personally identifiable information available through the Site.

Our Forums are made to make it easy for users to share information. Information, products, services, and other materials on our Forums come from our staff and other contributors, some of whom use anonymous screen names and are not otherwise connected with GWF (“Third Party Materials”). You agree that our Forums have a lot of information, including Third Party Material, and that people who use them sometimes post messages or make statements that are wrong, misleading, or deceptive, whether on purpose or by accident. We don’t control, don’t agree with, and aren’t responsible for these messages or statements, or for any opinion, advice, information, or other content or Third Party Materials made or displayed on the Site or Forums by third parties, whether they are visitors to the Site, members of the GWF community, or others. The opinions expressed in the Forums are those of the people who post them, not necessarily the opinions of GWF. We are not responsible for any mistakes or omissions in articles or postings, for links in messages, or for the results of using such information or Third Party Materials. We, our affiliates, suppliers, or agents are not responsible for any loss or damage you might experience if you use this information or Third Party Materials.

We are not required to keep an eye on the Site, the Forums, or any Submissions or other materials (including Third Party Materials) that you or other people send or post on the Site or the Forums. You agree that we and our affiliates have the right (but not the obligation) to monitor or analyze your access to or use of the Site and the Forums and the materials you transmit or post, including Submissions; to evaluate, change, or remove any such materials (including, without limitation, any Submissions or postings to a Forum) before or after they appear in a Forum; to disclose such materials and the circumstances surrounding their transmission to any third party.

No part of the Site may be copied, sold, resold, visited, or used in any other way for a commercial purpose. If you want to use or download any of the Materials, you must agree to the terms and conditions of any license agreements related to those Materials, even if they were made by a third party. You agree to these terms and conditions when you buy or use the Materials. We may let you use certain Materials for personal, non-commercial purposes through the Creative Commons Attribution-Noncommercial-Sharealike License (the “Creative Commons License”), as stated in a notice at the bottom of such Materials. You can use these Materials as long as you follow the rules of the Creative Commons License, which require, among other things, that you give credit to GWF for these Materials (or the applicable GWF-affiliated or contracted entity identified in such notice). Even though you can only use our name to meet the Creative Commons License’s attribution requirement, please keep in mind that you can’t use our logos or other Trademarks, as explained in Section 2 above. Any permission or license given by GWF automatically ends if the Site or any Materials are used without permission. You have a limited, revocable, and nonexclusive right to create a link to GWF’s home page, as long as the link doesn’t show GWF, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive way.
Without limiting what has already been said, you can only use the Member Services for personal, non-business purposes. You agree not to use any Member Service, in whole or in part, for any public presentation, even if there is no fee (except where such use would not constitute a copyright infringement).

You also agree that GWF is not responsible or liable, directly or indirectly, for any damage or loss caused or thought to be caused by or in connection with the use of or reliance on any such content, goods, services, or Third Party Materials available on or through any such site or resource. Before you do any kind of online or offline business with a third party, we strongly advise you to do whatever research you think is necessary or appropriate.

6. YOUR ACCOUNT

You agree that we have the right to end your access to and use of all or part of the Site if any of the information you give us is false, wrong, out of date, or incomplete.
You may be asked to choose a username and password as part of the registration process. We may not give you a username or password that you choose when you sign up, or we may ask you to change it. This includes anything that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is vulgar or otherwise offensive, or may cause confusion. You are responsible for keeping your username and password secret and for how they are used or abused. You also agree not to share or sell your use of or access to the Site with anyone else. If you think your account with us is no longer safe, you need to tell us right away and change your username or password. YOU ARE RESPONSIBLE FOR KEEPING YOUR USERNAME AND PASSWORD A SECRET AND FOR ANY AND ALL ACTIVITIES (INCLUDING BUYING, IF APPLICABLE) THAT ARE DONE THROUGH YOUR ACCOUNT.

  • • Use a fake e-mail address, pretend to be someone else or something else, or mislead in any other way about where the content came from;
  • • Say or imply that we agree with anything you say without our written permission first;
  • • Send (a) any content or information that is illegal, fraudulent, threatening, abusive, libelous, defamatory, obscene, or otherwise objectionable or doesn’t respect the rights and dignity of others; (b) any material, non-public information about companies without permission; (c) any material protected by trade secret, copyright, trademark, right of publicity or privacy, or any other proprietary right of a third party; or (d) any advertisement.
  • • Use any GWF Trademark or GWF graphics, logos, page headers, button icons, scripts, or service names;
  • • Get rid of any notices about copyright, trademarks, or other intellectual property rights that are on the Site or any Materials;
  • • “Frame” or “mirror” any part of the Site or use any part of the Site in any other way in a product or service without our written permission;
  • • Get, gather, or store other users’ personal information or other information;
  • • Be rude to other users;
  • • Stop or prevent any other visitor or member from using the Site, including, but not limited to, by “hacking” or defacing any part of the Site;
  • • Send spam or a lot of emails;
  • • Without GWF’s written permission, copy, change, adapt, translate, make derivative works from, sell, rent, lease, loan, timeshare, distribute, or make any other use of any part of the Site or any use of the Site other than what is specifically allowed here;
  • • Reverse engineer, decompile, or disassemble any part of the Site unless doing so is expressly forbidden by law;
  • • Send any software or other materials that have viruses, worms, trojan horses, Easter eggs, bugs, date bombs, time bombs, spyware, or other destructive items; or
  • • Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “scrape,” “data mine,” or collect Site content in any other way, or to copy or get around the Site’s navigational structure or how its content is shown.

When you use the Member Services, you also promise that you won’t (and won’t try to):

  • • use any part of the Member Services in a way that is against the law or for a purpose that is against the law;
  • • Give someone else your GWF account password so they can use parts of the Member Services that they didn’t order;
  • • copy, sell, rent, or give a third party a license to use the Member Services;
  • • get around, reverse-engineer, change, disable, or otherwise mess with any security technology that GWF or any third party uses to protect the Member Services, or encourage or help anyone else to do so;
  • • access the Member Service in a way that GWF hasn’t approved, or remove any legal notices or labels from the Member Service.
  • • give any false, inaccurate, or misleading information to misrepresent your location or place of residence, and you won’t try to get around any restrictions on access to or availability of the Member Services or content within the Member Services.

Summary:

This section gives some ground rules to protect our Site community and make sure that all users can get the most out of our Site. In addition to the rules listed above, this Code of Conduct says you can’t bother or spam other users, post inappropriate content, send viruses or do anything else that might be annoying or illegal. We don’t want to have to cut off your access to our Site, but we can if you break our Code of Conduct or these terms, or act badly in any other way when you use our Site. Please be kind to the other people who use our Site and tell us if you think someone is behaving badly!

You can’t just do whatever you want when you use Member Services. For example, you can’t try to get around the rules we have about who can use the Member Services or when they are available.

8. MAKING PURCHASES; MEMBERSHIP FEES

Payment: If you want to buy products or services described on the Site, such as Member Services, GWF or a third-party provider of the product or service may ask you for information about your purchase, such as your credit card number and other details. You promise and guarantee that you have the right to use any credit card you give us for your purchase. You understand that GWF will handle this kind of information in the ways outlined in our Privacy Policy. You agree that all of the information you give to GWF or the third-party provider will be correct, up-to-date, and full. You agree to pay all charges made to your account and credit card (or another payment method you may use) at the price(s) in effect when those charges were made. You will also have to pay for any taxes, shipping, and handling costs that go along with your purchases.
Providers of third-party payments. All payments will be made through a platform run by a third party. GWF accepts payment through the current payment method shown at the time of purchase. This could be a credit or debit card, or any other form of payment that GWF makes available to you from time to time. You agree to follow any relevant Terms of Service or other legal agreement, whether it’s with GWF, Apple, Stripe, Google, PayPal, or another third-party platform, that governs how you use a given payment processing method.

Fees for joining. Payments that keep coming out are subscription fees for the Member Services (except where identified as otherwise). The term can be a month or a year, depending on what was said during the transaction. When you pay the first installment of your subscription fees, your subscription will start. The subscription is automatically renewed every month or year, depending on how often the subscription fees are paid. Fees are charged every month or once a year on the same day of the month that the subscription started. (For example, if a monthly membership started on the 29th, 30th, or 31st of a given month, it will renew on the last day of any month that doesn’t have that many days.)

Prices for Member Services can change at any time, and GWF does not offer price protection or refunds if prices go down or if there is a sale. You agree to pay for any Member Services you order. Your credit card or another form of payment will be charged the price and billing period listed on the relevant Member Services offer, plus any extra amounts for taxes, bank fees, and changes in currency. If you buy an automatically renewing subscription, you agree that GWF will charge the payment method on file on the first day of each billing period for that subscription. If the payment method on file becomes invalid due to an expired credit card or other similar reason and we are unable to charge you on the next billing period, GWF reserves the right to immediately cut off your access to any Member Services you have ordered until you update your payment method. GWF may cancel your subscription if you don’t change your payment method within a reasonable amount of time.

Taxes. If GWF has to collect or pay taxes because you bought Member Services, you will be charged for those taxes at the time of each purchase or at another time that makes sense. Also, if the law says so, you are responsible for letting the government know about and paying certain taxes related to your purchase and use of Member Services. Included in these taxes may be duties, customs fees, or other taxes (other than income tax), as well as any penalties or interest that may apply to your purchase.

How to cancel and get a refund. You can cancel your Member Services at any time by changing your plan in the Membership Details section of the Settings tab in your member account or by emailing GWF at [email protected]. If you buy a Member Services subscription that automatically renews, you can cancel it at any time before the end of the current billing period. The cancellation will take effect at the beginning of the next billing period unless GWF tells you otherwise. You can still use the Member Services from the time you cancel until the beginning of the next billing period, but you won’t get a refund or credit for the days left in your current billing period. Paid subscription fees are final and cannot be refunded unless GWF says otherwise. If GWF has a good reason to believe that a user has broken these Terms of Service, it can end the user’s subscription and access to Member Services without warning or refund. [email protected] is the email address to use to ask for a refund.
Important Notice About the Site’s Products or Services. Descriptions or pictures of products or services, as well as references to them, on the Site, do not mean that GWF supports those products or services. We don’t promise that these descriptions, images, or references are correct, true, or up-to-date. We reserve the right, without notice, to change these descriptions, images, or references, limit the number of orders for any product or service, or refuse service to you. Before GWF accepts any order, the information about the purchase may need to be checked. Any product or service’s price and availability can change at any time without notice. It is up to you to follow all the rules about buying and using any product or service.

Summary:

On our Site, we may offer different products or services for sale. Please keep in mind that we could run out of these products or services, change them, or decide not to sell you anything at any time. Just because we offer a product or service on our Site doesn’t mean we recommend it, and you should make sure you can use a product or service before buying it. All purchases made with your username and password are your responsibility. If you give us your credit card information to buy something, you are telling us that you are allowed to use that credit card.

If you buy Member Services, your subscription will be renewed automatically, and you’ll permit us to charge you each billing cycle. The price of a subscription may change, and you can cancel it at any time. We can cancel your subscription if we can’t charge the payment method we have on file for you or if we think you are breaking these Terms of Service. Fees for subscriptions are final and cannot be refunded.

9. CLAIMS OF INFRINGING RIGHTS TO WORK
